Why instituting proceedings a lawsuit against AMDH Khénifra section in the person of its President
Concise Report
Khénifra AMDH Section continues since its foundation in 2001 to receive "applications support" from citizens who are subjects of human rights violations either on political, civil, socio-economic or environmental level.
Violators of these rights are more particularly local authorities and / or local employers. Our Association intervenes with the concerned parties according to clearly defined rules to inquire of the implications and consequences of the violations in question while keeping the distance that requires a follow-up that is objective and impartial.
But in recent years, thanks to the good reputation that the local Section forged with citizens in the Khénifra province and even throughout the region, other victims of violations who preferred to remain silent by fear of reprisals, are beginning to manifest itself by contacting the AMDH – local Section - and the rights violators this time belong to another category of violators other than State and / or employers: It’s a family, notably the Amahzoune and Amhrouk family close to the Moroccan royal palace; one of Amahzoune daughters is the Morocco’s King mother. Amahzounes and Amahroukes are cousins.
Moreover, after careful examination of all the dossiers related to the families in question and after noticing the competent authorities’ deficiencies in judicial proceedings level related to these violations, AMDH Khénifra section had to take the steps needed to verify the reasons which have left most citizens' complaints pending.
Thus AMDH Section wrote to inform the authorities asking for hearings and every time we realize that these families are above all laws and local officials are not able to do their duty: law enforcement.
Faced with this situation, the AMDH section is obliged to call on local, national and international public opinion, by way of press communiqués, sit-in and peaceful marches to denounce on the one hand these aggressions against citizens and on the other hand the authorities inability to enforce the laws ...
And it is in this context, that the president of Khénifra AMDH section and the weekly "Al Michaal" are subjects to a legal complaint from a family association named " Amahzoune Moha Ouhmmou Association ": they should be presented at court in Casablanca on 16 June, 2009 - with the charge: publication of defamatory statements against Amahzoune family and use of the king’s photos! Knowing that the majority of complaints citizens against these families have never known an end unless verdicts against the plaintiffs!
The Khénifra AMDH section call for a sit-in had gathered over 4000 people in the city center. This sit-in was held against Amahzoune’s family and notably Hafsa Amahzoune, the king maternal aunt, who assaulted with knives a lawyer in front of the police-station and in the presence of police officers helpless eyes without any intervention to protect the citizen who went to ask shelter and protection!
The complaint against the president of the AMDH khénifra and the director of the weekly "Al Michaal" is an attempt to intimidate human rights militants and independent press and is a message that is meant to limit or reduce the work of human rights defenders in a region where human rights violations are at their height and especially when the violators are families close to the Moroccan royal palace.
Some examples of violations committed by Amahzoune family and followed up by Khénifra AMDH section.
1 - Complaint for racket of 30 million centimes against Hafsa amahzoun’s son.
• The victims are:
1 - Boussetta kabir
2 - Mohamed Slak
3 - Bakbach Moha
4 - Mohamed Ajouj
5 - Ali Mansouri
They all live in Aguelmous - Khénifra -
* Complaint lodged in September 2006 with witnesses but vainly.
2 – Complaint lodged against Mohamed Serouiti the husband of Mina Amahzoune the King’s aunt for stealing 23 head of sheep found in his stable.
• The victim is:
1 – The breeder Mohamed ben Halou
The complaint was filed on August 07, 2008 without results.
3 – The Amahzoune family members had laid their hands on Ait Lahcen Ait Moussa OUSSAID tribe lands despite the royal ruling commission 519 - 1979 ordering to restore these lands to their rightful owners above mentioned.
The file is still pending
4-Moha Achichaw sentenced to 3 months imprisonment for harming Morocco's sacred values - the King:
One member of the Amahzoune family with whom the victim had a dispute about a plot had been accused of insulting the person of the king!
5 - Hassan Nouri arrested by the Mrirt royal gendarmerie on Amahzoune Hafsa’s demand who threatened to kill him if he is ever released. The gendarmerie report drawn up mentioned this threat that took place within the brigade. After which the gendarmerie has advised the Mrirt prosecutor who gave the order to keep the victim in their cells to avoid the worst!
Conclusion:
These are only examples of the files relating to violations committed by Amahzoune and Amahrouk families and the AMDH section has other similar files and expects to use all legal means to denounce the abuses of these families and the authority’s complicity.
